Notice and Takedown Policy

Governing law: Digital Millennium Copyright Act (DMCA) and applicable IP legislation

Our Commitment

We take copyright infringement very seriously, and we are committed to comply with the applicable copyright and intellectual property legislation, including the Digital Millennium Copyright Act (“DMCA”).

We reserve the right to block access to and/or remove material that we believe in good faith to be copyrighted material that has been illegally copied and distributed by any of our users, advertisers, affiliates, content providers, members, or licensees.

We also reserve the right to discontinue the provision of our services to any user who is deemed to be a repeat or blatant copyright infringer.

Dmca Reference

This policy is intended to comply with 17 U.S.C. § 512 (the “DMCA Safe Harbor”). Notices submitted under this policy must meet the statutory requirements of 17 U.S.C. § 512(c)(3).

Notice Requirements

If you believe that material available on our Services infringes upon your copyright, please send a written notice of claimed infringement to our Designated Agent (see §5). Your notice must include all of the following:

The identity (including registration/identification number) of the notifier.

The identity of the copyright violator, e.g. username or name (if known).

The date of notification.

A physical or electronic signature of a person authorized to act on behalf of the owner of the exclusive right that is allegedly being infringed.

Identification of the copyrighted work or works claimed to have been infringed, or a representative list if multiple works are covered by a single notification.

Identification of the alleged infringing content, including information regarding its location on our Services — including screenshots and direct links — sufficient for us to locate the material.

Contact information about the notifier, including email address, physical address, website or URL, and jurisdiction.

A statement that the notifier has a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

A statement made under penalty of perjury that the information in the notification is accurate and that the notifier is authorized to act on behalf of the owner of the exclusive right that is allegedly infringed.

Penalty Of Perjury

Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages, including costs and attorneys’ fees.

Company Response to Notices

Upon receipt of a notice that meets the requirements set out in §1, we may take the following actions at our sole discretion:

  • Remove or disable access to the material that is claimed to be infringing.

  • Notify the content provider, member, or user that we have removed or disabled access to the material.

  • Terminate such content provider’s, member’s, or user’s access to the Services if we determine that they are a repeat or blatant copyright infringer.

We reserve the right not to act on notices that are incomplete, in bad faith, or that do not meet the statutory requirements of the DMCA.

Counter-Notice Process

If you believe that material you posted on our Services was removed or access to it was disabled by mistake or misidentification, you may file a counter-notice with our Designated Agent. Your counter-notice must include:

A physical or electronic signature of the content provider, member, or user.

Identification of the alleged infringing content that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access to it was disabled (including screenshots and links where possible).

A statement that the content provider, member, or user has a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.

The content provider’s, member’s, or user’s name, physical address, and email address.

Counter-Notice Warning

By submitting a counter-notice, you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located. If you are outside the United States, you consent to the jurisdiction of any judicial district in which Minute Media may be found. Knowingly submitting a false counter-notice may also result in liability under 17 U.S.C. § 512(f).

Reinstatement Timeline

Upon receipt of a valid counter-notice, we will promptly provide a copy to the original complaining party and inform them that we will replace the removed material or cease disabling access to it in 10 to 14 business days.

We will replace the removed material and cease disabling access to it within 10 to 14 business days of receiving the counter-notice, provided our Designated Agent does not first receive notice from the copyright owner or their authorized representative that a court action has been filed seeking an order to restrain the content provider, member, or user from engaging in infringing activity relating to the material on our Services.
